Welcome to Wilmington Marine Mechanic (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the website https://wilmingtonmarinemechanic.com (the “Site”) and the referral service we provide through it (“Services”). By accessing the Site or submitting a request, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site or our Services.

About Us — What We Do (and Don't Do)

Wilmington Marine Mechanic operates a referral website. We help property owners in Wilmington, NC, and surrounding areas connect with independent, licensed local Marine Mechanic professionals (“Contractors”).

**We are not a Marine Mechanic contractor, and we do not perform any Marine Mechanic work ourselves.** Our role is limited to collecting your request and matching or forwarding it to one or more independent Contractors who may then contact you. Any inspection, repair, installation, maintenance, or other work is performed solely by the independent Contractor you choose to engage — not by us.

Our goal is to connect you with a qualified, licensed local expert who is well suited to your job. We may screen or select Contractors we work with, but the Contractors remain independent third parties, and their work is their own responsibility. We reserve the right to modify, suspend, or discontinue the Site or our referral Services at any time without prior notice.

Relationship Between You, Us, and the Contractor

You understand and agree that:

  • Any agreement for Marine Mechanic work is formed **directly between you and the Contractor**, on the Contractor’s own terms. We are not a party to that agreement.
  • Contractors are **independent third parties**, not our employees, agents, partners, or joint venturers. We do not supervise, direct, or control their work.
  • We do not guarantee that any Contractor will contact you, accept your job, be available, or complete any work.
  • You are responsible for **independently verifying** each Contractor’s license, insurance, qualifications, references, and suitability before authorizing any work.

Eligibility

By using the Site or submitting a request, you confirm that:

  • You are at least 18 years of age, or accessing the Site under the supervision of a parent or legal guardian
  • You have the legal authority to enter into these Terms
  • The information you provide to us is accurate and complete

Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the Site. Specifically, you agree not to:

  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Site, server, or related systems
  • Interfere with or disrupt the operation of the Site or networks connected to it
  • Use any automated system (bots, scrapers, spiders, etc.) to access the Site without our written permission
  • Collect or harvest personal information from other users of the Site
  • Transmit viruses, malware, or other harmful code
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission

We reserve the right to refuse service, terminate access, or pursue legal action for any violation of these Terms.

Submitting a Request

When you contact us through the Site, by phone, or by other means, you are submitting a request to be connected with a Contractor — **not a binding contract for services, and not an appointment.** We reserve the right to decline, forward, or route any request at our discretion.

You are responsible for providing accurate information about the work needed, your location, and any conditions relevant to the job. This information may be shared with one or more Contractors so they can respond to you. If material information is missing or inaccurate, a Contractor may decline the job, adjust pricing, or reschedule.

Fees and Payment

Using the Site to request a referral is free to you unless we clearly state otherwise. **We do not set prices for, invoice for, or collect payment for the actual Marine Mechanic work.** All pricing, estimates, deposits, and payment for any work are arranged and handled **directly between you and the Contractor**, on the Contractor’s terms.

Any compensation we receive is typically paid by Contractors for referrals or advertising, not by you. You should confirm all pricing and payment terms directly with the Contractor before authorizing work.

No Endorsement; No Warranty on Contractor Work

While we aim to work with licensed, reputable local experts, **we do not warrant, guarantee, or assume responsibility for any Contractor** or their work, including their licensing, insurance, qualifications, workmanship, timeliness, conduct, pricing, or the quality, safety, or outcome of any work performed. A referral is not an endorsement or a guarantee of performance.

Any warranty or guarantee on work performed is provided **solely by the Contractor**, under your agreement with that Contractor. We are not the warrantor of any work or of any parts installed.

EXCEPT AS EXPRESSLY STATED, THE SITE AND OUR REFERRAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Wilmington Marine Mechanic SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of, or inability to use, the Site or Services
  • Any unauthorized access to or use of our systems
  • Any errors, omissions, or inaccuracies in content on the Site
  • **The acts, omissions, work, workmanship, delays, conduct, pricing, or any damage or injury caused by any Contractor** connected to you through the Site
  • Any agreement, dispute, or transaction between you and a Contractor
  • Any property damage, personal injury, or loss arising from work performed by a Contractor

**We are a referral service only. We do not perform the work, and we are not responsible or liable for the work performed by any Contractor.** Any claim regarding the work itself must be pursued against the Contractor who performed it.

Our total liability for any claim arising from or related to the Site or our referral Services shall not exceed the greater of the amount you paid us (if any) for the referral giving rise to the claim, or USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Wilmington Marine Mechanic, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Site or Services
  • Your engagement of, agreement with, or dispute with any Contractor
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Any false or misleading information you provide to us or to a Contractor

Intellectual Property

All content on the Site, including text, images, logos, graphics, and design, is owned by or licensed to Wilmington Marine Mechanic and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written permission.

You retain ownership of any content you submit to us (such as photos or descriptions of your request) but grant us a non-exclusive, worldwide, royalty-free license to use that content as needed to operate our referral Services — including sharing it with Contractors so they can respond to you — improve our business, and respond to your inquiries.

Third-Party Links and Services

The Site may contain links to, or connect you with, third-party websites, Contractors, or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, practices, or work of any third party. Your interactions and agreements with any Contractor or other third party are solely between you and that third party.

Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which describes how we collect, use, and share (including with Contractors) your personal information. By using the Site or Services, you consent to the data practices described in the Privacy Policy.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our referral Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in North Carolina, or in a small claims court of competent jurisdiction in Wilmington, NC, at our discretion. This section governs disputes with us only; disputes about the work itself are between you and the Contractor.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Wilmington Marine Mechanic.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wilmington Marine Mechanic regarding your use of the Site and our referral Services, and supersede any prior agreements. They do not govern your separate agreement with any Contractor.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective Date” at the top of this page. Your continued use of the Site or Services after the changes become effective constitutes acceptance of the revised Terms.
